The head of the Doctors Syndicate delivers to the Speaker of the House of Representatives the union’s demands regarding the draft medical liability law
He met with the head of the Medical Syndicate, Dr. Osama Abdel Hay, Speaker of the House of Representatives, Counselor Dr. Hanafi Jabali, to review the conclusions of the Health Affairs Committee regarding the draft law submitted by the government issuing a law regulating medical liability and patient safety.
The head of the Doctors Syndicate delivered the demands of the Syndicate, which it deems important. Including it in the draft medical liability law, to ensure a fair and equitable law that protects the doctor, takes into account the nature of the profession, and preserves the doctor’s rights.
During the meeting, the head of the Doctors Syndicate praised the response of the Health Affairs Committee in the House of Representatives, headed by Dr. Ashraf Hatem addressed a number of requests from the Doctors Syndicate, hoping that the rest of the Syndicate’s demands will be responded to during the consideration of the draft law in the general session of the Council.
The most prominent demands of the Doctors Syndicate included 3 main demands, which are:-
< p>It is necessary to clearly distinguish between civil and criminal liability in the draft law, and to define gross medical negligence in a clear, precise and exclusive manner that does not lend itself to interpretation, because the penalty of imprisonment will result, and the abolition of the fine penalty in cases of technical error. its occurrence and “compensations” are sufficient. To redress the damage, as for gross negligence, the criminal penalty shall be imprisonment or a fine and compensation to the patient.
The Supreme Committee for Medical Liability shall be the sole technical expert at the investigation and litigation authorities, and it shall be stipulated that it is not permissible to investigate the doctor or take any action. From the investigation or trial procedures until after the issuance of the report of the Supreme Committee for Medical Liability, in addition to the necessity of referring complaints related to medical liability from patients and all investigative bodies to the Supreme Committee for Medical Liability.
The insurance fund must bear the entirety of Compensation, not just contribution to it, stressing the need to increase the penalty for assaulting health facilities and their workers.
